A SECURITY GUARD FIRM OR PRIVATE INVESTIGATION BUSINESS

QUESTIONS:
1. Would a prohibited conflict of interest be created were a full‑time, sworn municipal police officer to own or operate a security guard firm or private investigation business for profit unconnected with his department?
2. Would a prohibited conflict of interest be created were a full‑time, sworn municipal police officer to work during his off‑duty hours as a security guard or private investigator not assigned by his department?
In accordance with a prior opinion of this commission, CEO 76-101, a copy of which is enclosed, we answer question 1 in the negative.
In accordance with the rationale to CEO 76-101, question 2 also is answered in the negative, subject to the general restriction expressed in that opinion that the subject police officer may not have employment or a contractual relationship with a business entity which is doing business with the police department.
